Amendments to Federal Way Revised Code (FWRC), Title 19, “Zoning” Use Process II, Use Process III, Use Process IV, & Use Process V and Amendments to SEPA Exempt Level Thresholds in Title 14, “Environmental Policy”

Description: The City is proposing to amend the Use Process II, Use Process III, Use Process IV, and Use Process V decision criteria listed in Title 19 of the Federal Way Revised Code (FWRC). The proposed amendments will allow the City to condition site specific projects that are required to obtain land use process approval in order to mitigate for onsite or offsite traffic safety impacts to the overall transportation system, for all modes of transportation. The city will also amend sections of Title 14 of the FWRC for “Categorical Exemptions – Flexible Thresholds,” 14.15.030(1)(a) & (c-d).

The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment and an environmental impact statement (EIS) is not required under the Revised Code of Washington (RCW) 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist.

Further information regarding this action is available to the public upon request at the Federal Way Department of Community Development Services (Federal Way City Hall, 33325 8th Avenue South, PO Box 9718, Federal Way, WA 98063-9718). This DNS is issued under WAC 197-11-340(2). The lead agency will not act on this proposal for 14 days from the date below. Comments must be submitted by 5:00 p.m. on August 10, 2009.

Unless modified by the City, this determination will become final following the above comment deadline. Any person aggrieved of the City’s final determination may file an appeal with the City within 14 days of the above comment deadline. You may appeal this determination to the Federal Way City Clerk, at the address above, no later than August 24, 2009, by a written letter stating the reason for the appeal of the determination. You should be prepared to make specific factual objections.
